Aivilo Technologies Pty Ltd owns and operates the BlockBeacon.io service. “You” means you, your company, and any of your employees, representatives, users, and agents that use the Services (defined below) provided by Aivilo Technologies Pty Ltd.

Your use of the Site and associated products and services is subject to the terms, conditions, and disclaimers set forth below; to our Privacy Policy; and to all applicable laws and regulations. In addition, Aivilo Technologies Pty Ltd reserves the right to terminate access to the Site for any reason, and to take any other actions that Aivilo Technologies Pty Ltd, in its sole discretion, believes to be in the interest of the company and some or all of its users and customers.

Aivilo Technologies Pty Ltd reserves the right to modify these disclaimers, terms, and conditions of access, without advance notice.

This is a binding contract between Aivilo Technologies Pty Ltd and you. By accessing our Sites and Services, you hereby accept this agreement. As a material condition of such use, you warrant that you are over the age of thirteen and that you have provided accurate and complete information in any communication with Aivilo Technologies Pty Ltd.

If any portion of the services requires you to register, you must complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form. You are entirely responsible to maintain the confidentiality of your password and login name any and all activities that occur under your account.

You may change your password at any time by following instructions or by contacting customer service and agree to immediately notify Aivilo Technologies of any unauthorised use of your login name or any other breach of security known to you.

As a condition of using the Site and Services, You shall not use the Services or any portion of Your website(s) or mobile applications for any purpose that is unlawful, unethical, or prohibited by the Agreement or this TAC or that could create liability for Aivilo Technologies Pty Ltd. You must not use the Services in any manner that could damage, disable, overburden, or impair any Aivilo Technologies server, or the network(s) connected to any Aivilo Technologies server, or interfere with any other party's use and enjoyment of any Services.

You shall not attempt to gain unauthorized access to any Services, other accounts, computer systems or networks connected to any Aivilo Technologies server or to any of the Services, through hacking, password mining or any other means. You shall not operate robots or spiders to scan Aivilo Technologies databases or web pages. You shall not use "deep linking" to Aivilo Technologies web pages.

You are solely responsible for any and all acts and omissions that occur during or relating to your use of the Sites, and you agree not to engage in unacceptable use of the Sites, which includes, without limitation, use of the Sites to:

  • Harm or threaten to harm users or members of the general public in any way, or "stalk" or otherwise harass any other person or entity;
  • Post or transmit any Content that is unlawful, false or misleading, grossly offensive, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, pornographic, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable;
  • Disseminate or transmit "spam," unsolicited messages, chain letters, any advertisements, solicitations, pyramid schemes, investment opportunities or other unsolicited commercial communication;
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
  • Post any unsolicited or unauthorized advertising, promotional materials, or any other form of solicitation except in areas that are expressly designated by the Sites for such purpose;
  • Violate any law (whether local, state, national, or international), whether or not intentionally;
  • Forge headers or otherwise intentionally disguise the origin of any content or communication; interfere with or disrupt the Sites, or servers or networks connected to the Sites; or disobey any requirements, procedures, policies, or regulations of networks connected to the Sites;
  • Obtain, copy, monitor, index or data mine through the use of a robot, spider, any automated device, or any manual process, the Sites or the contents (except as expressly permitted by Aivilo Technologies Pty Ltd);
  • Remove any copyright, trademark or other proprietary rights notices contained in the Sites;
  • "Frame" or "mirror" any part of the Sites; or
  • Engage in any other activity deemed by Aivilo Technologies Pty Ltd to be in conflict with the spirit or intent of this agreement or that might violate the rights of others or give rise to liability.

In using our Services, you may view content or utilize services provided by third parties, including links to web pages and services of such parties (“ Third Party Content”). We do not control, endorse or adopt any Third-Party Content and will have no responsibility for Third Party Content including, without limitation, material that may be misleading, incomplete, erroneous, offensive, indecent or otherwise objectionable in your jurisdiction.

In addition, your dealings or correspondence with such third parties are solely between you and the third parties. We are not responsible or liable for any loss or damage of any sort incurred as a result of any such dealings and you understand that your use of Third Party Content, and your interactions with third parties, is at your own risk.

Throughout BlockBeacon.io, certain services may contain an affiliate link to several externals services. By accepting our Terms and Conditions, you agree that we can earn a commission via our affiliates which we use to help subsidise our services.

You agree to hold harmless Aivilo Technologies Pty Ltd (and each of our officers, directors, members, employees, agents and affiliates) from any claim, demand, action, damage, loss, cost or expense, including without limitation reasonable legal fees, arising out or relating to:

  • Your use of, or conduct in connection with, our Services;
  • Any feedback or submissions you provide;
  • Your violation of these Terms; or
  • Violation of any rights of any other person or entity.
  • If you are obligated to indemnify us, we will have the right, in our sole discretion, to control any action or proceeding and determine whether we wish to settle it.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BLOCKBEACON.IO AND THE BLOCKBEACON.IO CONTENT ARE PROVIDED ON AN “ AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT AND ANY WARRANTIES IMPLIED BY ANY COURSE OF PERFORMANCE OR USAGE OF TRADE. BLOCKBEACON.IO DOES NOT REPRESENT OR WARRANT THAT BLOCKBEACON.IO AND THE BLOCKBEACON.IO CONTENT: (A) WILL BE SECURE OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ARE ACCURATE, COMPLETE, RELIABLE, CURRENT OR ERROR-FREE OR THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED; AND (C) ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF BLOCKBEACON.IO AND THE BLOCKBEACON.IO CONTENT IS SOLELY AT YOUR OWN RISK. SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED TERMS IN CONTRACTS WITH CONSUMERS, SO SOME OR ALL OF THE DISCLAIMERS IN THIS SECTION MAY NOT APPLY TO YOU.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BLOCKBEACON.IO OR THE BLOCKBEACON.IO PARTIES BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, LOSS OF USE, LOSS OF PROFITS OR LOSS OF DATA, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE) OR OTHERWISE, ARISING OUT OF, OR IN ANY WAY CONNECTED WITH, THE USE OF, OR INABILITY TO USE, BLOCKBEACON.IO OR THE BLOCKBEACON.IO CONTENT. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE AGGREGATE LIABILITY OF BLOCKBEACON.IO, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), PRODUCT LIABILITY, STRICT LIABILITY OR OTHER THEORY, ARISING OUT OF OR RELATING TO: (A) THE USE OF OR INABILITY TO USE BLOCKBEACON.IO CONTENT; OR (B) THESE TERMS EXCEED ANY COMPENSATION YOU PAY, IF ANY, TO BLOCKBEACON.IO FOR ACCESS TO OR USE OF BLOCKBEACON.IO.

You may submit questions, comments, feedback, suggestions, and other information regarding SkillsBeacon.com (we call this “Feedback“). You acknowledge and agree that Feedback is non-confidential and will become the sole property of Aivilo Technologies.

Aivilo Technologies shall own exclusive rights, including, without limitation, all intellectual property rights, in and to such Feedback and is entitled to the unrestricted use and dissemination of this Feedback for any purpose, without acknowledgment or compensation to you.

We may suspend or terminate your access to the Services in our sole discretion, immediately and without prior notice, and delete or deactivate your Account and all related information and files in such without cost to you, including, for instance, in the event that you breach any term of these Terms. Termination of our agreement with you as a result of you breaching any one or more of these Terms, will not end provisions of these Terms that are capable of surviving termination.

The laws governing this agreement will be the laws in Victoria, Australia and you irrevocably submit to the exclusive jurisdiction of its Courts and its Appellate Courts and the jurisdiction of the Federal Court of Australia sitting in Victoria.

For the purposes of this agreement the words “SkillsBeacon", "We", "Our" and "Us" refer to Aivilo Technologies Pty Ltd (operating under the name BlockBeacon.io) and "Site" to materials delivered on www.BlockBeacon.io.
